Terms for using this website and submitting a financing request.

1. Broker role—not a direct lender

Nicolas Lescalier is a commercial finance broker and Senior Funding Advisor at Premium Merchant Funding (“PMF”). Neither this website nor a conversation with Nicolas creates a commitment to lend. Financing, if available, is provided by third-party lenders, funders, banks, or other providers that make their own underwriting, approval, pricing, and documentation decisions.

Nicolas and PMF may receive compensation from a financing provider, from transaction proceeds, or as otherwise disclosed in connection with a completed transaction.

2. Business-purpose use

The website is intended for lawful commercial and business-purpose financing inquiries. By submitting a request on behalf of a business or property-owning entity, you represent that you are at least 18 years old, are authorized to provide the information, and are seeking financing primarily for business or commercial purposes.

3. No offer, approval, or guarantee

Website content, calculators, ranges, timing references, examples, emails, and preliminary discussions are informational only. They are not offers, approvals, term sheets, legal advice, tax advice, accounting advice, investment advice, or guarantees of funding. Product availability varies by provider, state, industry, credit profile, collateral, revenue, documentation, and other underwriting factors.

Submitting a form does not create a broker agreement, lender relationship, fiduciary relationship, or obligation to arrange financing.

4. Accuracy and authorization

You agree to provide information that is accurate, current, and complete to the best of your knowledge. You authorize Nicolas and PMF to review the submitted business information, contact you about the request, and share the information with appropriate third-party financing providers for evaluation.

A public-form submission does not authorize a credit pull. If a provider requires consumer or business credit information, bank verification, or other formal authorization, that authorization should be requested separately.

5. Communications

By submitting a phone number or email address, you authorize service-related calls and emails concerning the request, including communications made using automated systems where permitted. Optional marketing-text consent is separate and is not required to request financing.

If you separately opt in to marketing texts, message frequency varies, message and data rates may apply, and consent is not a condition of financing. Reply STOP to opt out or HELP for assistance. Support is available at 305.699.3636.

6. Calculators and representative examples

Calculators use simplified assumptions and may not include origination fees, closing costs, variable remittances, holidays, irregular payment schedules, prepayment provisions, compounding conventions, or provider-specific terms. Results should be independently verified against actual financing documents.

Case examples are representative educational scenarios unless expressly identified as verified client transactions. They are not testimonials, performance records, or promises that another applicant will receive the same structure or result.

7. Third-party websites and providers

The website links to PMF, LinkedIn, Calendly, Formspree, financing providers, and other third-party services. Nicolas does not control and is not responsible for third-party content, availability, privacy practices, security, or contractual terms. Review the applicable provider’s documents before proceeding.

8. Prohibited use

You may not use the website to submit false information, impersonate another person or business, interfere with website operation, transmit malicious code, scrape personal information, violate law, or pursue financing for unlawful purposes.

9. Intellectual property

Website design, text, calculators, and original materials are protected by applicable intellectual-property laws. You may use the calculators and guides for your own internal business evaluation, but may not copy, resell, republish, or misrepresent the materials as your own without written permission.

10. Disclaimers and limitation

The website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Nicolas and PMF disclaim warranties regarding accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement. Neither Nicolas nor PMF is responsible for decisions made solely from website content or calculator output.

Nothing in these terms excludes rights or liabilities that cannot legally be excluded.

11. Changes and contact

These terms may be updated as the website, products, providers, or applicable requirements change. Continued use after updated terms are posted constitutes acceptance of the revised terms.
